1. The Defendants jointly do so to the Plaintiff (Appointed Party) and the Appointed H:

(a) Of the lands listed in Appendix 1 List 3;

1. Basic facts

A. On January 16, 2018, the Plaintiff and the Appointor H (hereinafter “Plaintiff, etc.”) have won each land listed in the separate sheet (hereinafter “each land of this case”) in the Gu Government District Court I auction case by 1/2 shares, and paid in full the successful bid price on each land of this case on January 26, 2018, and completed each registration of ownership transfer on each land of this case on January 26, 2018.

B. At the time when the Plaintiff et al. acquired ownership of each of the instant land, Defendant B Co., Ltd. (hereinafter “Defendant B”) occupied each of the instant land by means of parking of working vehicles for the removal of trees, container container for warehouse, loading of wood, etc., and Defendant C is the president of Defendant B.

C. On March 5, 2018, the Plaintiffs filed an application against Defendant B and C for a real estate delivery order with the District Court J, and the said court rendered a decision on March 5, 2018 that “Defendant B and C deliver each of the instant real estate to the Plaintiff, etc.”

On August 21, 2018, the Plaintiffs attempted to execute the delivery execution of each of the instant lands with the enforcement title of the order to deliver the said real estate. However, the Plaintiffs were unable to execute the execution on the ground that there exist several containers, buildings, wood, etc. on each of the instant lands (hereinafter “instant ground objects”).

According to the appraisal results of the appraiser L of this Court on February 20, 2019, the present status of each of the instant lands is as follows.
