A defendant shall be punished by imprisonment for four years.
Reasons
On July 28, 2006, the Defendant was sentenced to three years of imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes in Busan District Court, and on December 22, 2009, the Gwangju High Court sentenced three years of imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) and completed the execution of the sentence on April 29, 2012.
Criminal facts
1. On May 8, 2012, the Defendant: (a) committed a theft of a sum of KRW 1,300,000,000, including one gift certificate of KRW 20,000, market price, and one gold gift certificate of KRW 1,30,000, market price, and one sheet of KRW 1,30,00,000, in which the victim’s 4th class E clothes store located in Gwangju Northern-gu, Gwangju, which had been laid above the victim F, for the purpose of cutting clothes at the victim’s 60,00,000.
2. On May 8, 2012, the Defendant, at the 2nd floor G 2nd floor of the D department store, stolen the Defendant’s market value of KRW 110,000,00, 136,000, of the cash 26,000, on the part of the victim’s possession, kept the victim H on his/her own, for the purpose of cutting clothes at the 2nd floor G 2nd floor of the D department store.
3. On May 8, 2012, between 14:00 and 15:00 on May 8, 2012, the Defendant: (a) committed a theft that resulted in the Defendant’s loss of KRW 1,750,000,00 of the market price of the victim’s ownership, which was placed on the part of the second floor I store of the said D department store to raise clothes by the victim J, and KRW 750,000 of the market price of the victim’s 750,000,000, which was contained in the bank, and KRW 500,000,000 of the old Da department store; (b) KRW 1,150,000 of the cash gift certificates; and (c) the market price of KRW 50,00,00,000 of the modern department store.
4. On May 8, 2012, the Defendant: (a) on May 8, 2012, 14:25, 2012, at the second-class D department store located in K women’s second-class D department store, the Defendant’s market price of the victim’s possession, which was left above the victim’s clothes, was equivalent to KRW 500,000,000, and KRW 700,000.
