1. As to the Plaintiff, the Defendant and the selected parties C, D, E, F, G, and H KRW 47,060,820, respectively, and KRW 41,375,000 among them.
Reasons
1. Basic facts
A. The Plaintiff is a company with the purpose of specialized urban improvement business.
On May 15, 2008, the Eunpyeong-gu Seoul Metropolitan Government Office approved the establishment promotion committee for the M market consolidation project on May 15, 2008 with respect to the total area of the M market of the number of lots outside the Eunpyeong-gu Seoul Metropolitan City L (hereinafter “instant project zone”), and the said promotion committee was approved on January 12, 2009 by changing the market improvement project for the N District Urban Renewal Acceleration Promotion (hereinafter “instant promotion committee”).
The defendant is the chairperson of the promotion committee, who is the representative of the above promotion committee, and the selected parties C, D, E, F, G, H (hereinafter referred to as "appointed parties C and five others"), and theO are the promotion committee members.
B. On January 201, 201, the Plaintiff entered into a management services contract with the Defendant representing the instant promotion committee (hereinafter “instant services contract”). The Defendant, the president of the promotion committee, and the designated parties C, five promoters, andO guaranteed the implementation of the said contract.
The Promotion Committee of this case (hereinafter referred to as the "A") and the defendant (hereinafter referred to as the "B") shall select "B" as the manager pursuant to Article 14 of the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter referred to as the "Urban Improvement Act") for the professional management of the market improvement project implemented by "A" and enter into a contract as follows:
1. Project name: An urban renewal acceleration district market rearrangement project;
2. Location: Eunpyeong-gu Seoul Metropolitan Government L;
3. Land area: 5,775 square meters (where the area is changed due to a change in the business plan, it shall be the changed area).
4. Total floor area: by the details of authorization for project implementation;
5. Contract amount: 420,000,000 won (excluding value-added tax);
6. Details of the contract: All kinds of duties prescribed in Article 14 of the Act on the Maintenance and Improvement of Urban Areas.
7. Service period: From the day following the conclusion of the contract to the day of dissolution of the association.
8. The validity of the contract: (1) This contract shall be in accordance with the contract between A and B.
