Defendant
All appeals filed by A, B, C, and Prosecutor are dismissed.
Reasons
1. Summary of grounds for appeal;
A. In light of the various sentencing conditions in the instant case, Defendant A, B, and C, the lower court’s sentence against the said Defendants (Defendant A: imprisonment of one year and six months and a fine of 50,000,000 won, surcharge of 2,332,874,648 won, Defendant B: Imprisonment of eight months and a fine of 10,000,000 won, confiscation, and Defendant C: Imprisonment of eight months and a fine of 10,00,000 won, confiscation, and confiscation) is too unreasonable.
B. The lower court’s sentence against Defendant C and D (Defendant C: imprisonment of April 2 and fine of KRW 5,000,000, confiscation, and Defendant D: fine of KRW 5,000,000, which were imposed on Defendant C) in light of the various sentencing conditions of the instant case by the public prosecutor, is deemed to be too uneasible.
2. Determination
A. The circumstances favorable to the defendant include the following: (a) the defendant was examined with respect to the defendant A; (b) the defendant was aware of and against his mistake; and (c) the defendant did not have serious criminal records exceeding the same kind and fine.
However, the crime of this case was committed by the defendant, from April 28, 2007 to February 14, 2012, at H, which is a commercial sex business establishment of 502 the fifth floor of the 5th floor of the G building in Bupyeong-gu, Seocheon-gu, Seoul, 2007, 9 rooms, 8 guest rooms, 8 guest rooms, 1 massage rooms, 4 massage rooms, etc., and let female employees engage in commercial sex acts, which are considerably poor in the nature of the crime in light of the crime period, size, etc., and the act of arranging commercial sex acts such as the crime of this case did not cause considerable social harm, such as harming the sound sex culture and good customs by commercializing women's sex, and it is necessary to take strict punishment against the owner of illegal sex trafficking business establishment and establish a healthy sex culture, and when considering the following circumstances, the defendant tried to conceal his criminal punishment on the ground of so-called head of the crime, his age before and after the crime was committed.
