A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
1. The defendant is a person engaged in driving a motor vehicle B high-speed motor vehicle;
On May 1, 2020, the Defendant driven the above vehicle under the influence of alcohol of 0.173% in blood alcohol concentration at around 03:18, while driving the vehicle, and driven the three-lane road of D in front of D in Manyang-gu, Manyang-si, Gyeonggi-do, with two-lanes, toward the center shooting distance on the side of the wall mountain distance.
At the time, since it was difficult to move around at night, a person engaged in driving of a motor vehicle has a duty of care to safely drive the motor vehicle along the wheel and left, and even though there was an occupational duty of care to operate the motor vehicle by clearly operating the wheel and the steering gear, the defendant neglected to do so while under the influence of alcohol, and thereby, caused the part of the driver's seat of a FIst and other motor vehicle driven by the victim E (Nam, 43 years old) and the part of the Hastst or other motor vehicle driven by the victim G (Nam, 64 years old) to the front part of the Hast and other motor vehicle driven by the victim G (Nam, 64 years old). The above part of the Hast and other motor vehicle driven by the victim I, 65 years old.
Ultimately, the Defendant driven the above low-speed motor vehicle in a situation where normal driving is difficult due to the influence of alcohol, and suffered injury to the victim E, G and I, respectively, for about two weeks of medical treatment.
2. Around 03:18 on May 1, 2020, the Defendant driven the above B-hand car with a blood alcohol concentration of about 10 meters from the section of about 10 meters from the public parking lot to the front road located in the same Gu C from Gyeyang-gu K and the public parking lot in Ansan-si in Gyeonggi-do to the front road in the same Gu.
