The crime No. 1 and No. 2 of the ruling is to be committed in two months of imprisonment with prison labor for the crime No. 3 of the ruling of the defendant.

Punishment of the crime

On February 4, 2016, the Defendant was sentenced to a suspended sentence of three years at the Daegu District Court on one year and six months of imprisonment due to fraud, etc., and the judgment became final and conclusive on the 12th of the same month.

1. Around April 27, 2016, the Defendant posted a letter stating that he/she sells gift certificates to “Jinna,” which is an Internet trading site, at the Defendant’s residence located in Busan Metropolitan City (hereinafter “C”), and said, “A victim D who reported and contacted this letter will send a new world gift certificate if he/she transfers KRW 345,00 to the account.”

However, at the time, the defendant did not have the intention or ability to send a new world merchandise coupon even if he receives the purchase price of merchandise coupons from the victim.

Nevertheless, the Defendant, as seen above, received a false statement from the victim and received KRW 345,00 from the victim to the Daegu Bank Account in the name of E, and acquired a total of KRW 9,515,400 from April 27, 2016 to July 9, 2016, including the list of crimes (2016Da3443).

2. On June 29, 2016, the Defendant, around 15:47, 2016, posted a false statement that “I will sell F Public Performance Petet” on the Internet website at the place of residence located in Busan Metropolitan City, Busan Metropolitan City. The Defendant sent KRW 2.60,000 to G who reported and contacted the above article, and sent the performance Pet to the victim G who sent 2.60,000 won.

However, even if the defendant receives money from the victim, he did not have the intention or ability to sell the diskettes.

As such, the Defendant, by deceiving the victim, received KRW 2.60,00 from the victim to the Daegu Bank account under the name of the Defendant on the same day, and received a total of KRW 1,402,00 from around that day to July 14, 2016, together with the statement in the list of crimes (written 7 pages of the judgment) in attached Form 1,40,000 from the victims.

3. "The defendant of "2016 Highest 4470" shall be the victim E, who is an elementary school, in a park located in the Maok-dong, Busan Metropolitan City around September 11, 2015.
