A defendant shall be punished by imprisonment for not more than ten months.

The defendant shall be ordered to complete 40 hours of sexual assault treatment programs.

Punishment of the crime

On May 2, 2012, the Defendant: (a) reported that the Victim C (the age of 14 at that time) written a part-time job seeking on the Internet “China” car page, and sent contact to the victim; and (b) around June 2, 2012, the Defendant sent the victim a letter to the victim, stating, “A student’s heart is good at the same time on the ceiling, and the victim will be satising and satising.”; (c) made the victim enter the ceiling into the ceiling, and (d) made the victim have been aware of the fact at the same time.”

가. 피고인은 2012. 7. 하순경 대전 중구 D에 있는 E모텔에 위 피해자와 같이 투숙하여 피해자에게 술을 마시게 한 후 “사진을 찍는다, 얼굴 가려라, 엎드려 있어라, 두고두고 사진을 보겠다.”고 말하고 피해자가 싫다고 하면서 거부하였음에도 불구하고 소지하고 있던 디지털 카메라로 피해자의 알몸을 사진 촬영하고, 계속하여 피해자로 하여금 자신의 성기를 빠는 시늉을 하게 하면서 위 디지털카메라로 그 모습을 사진 촬영하였다.
