A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

"2016 Highest 2211"

1. Around March 2016, the Defendant made a false statement to the effect that “D” office located in “D” office located in “D,” in which he/she works as a factory site, purchased and accepted money from the victim E as the price for the purchase of middle and high machinery, and then divided 40% of the profits therefrom.”

However, as above, even if the Defendant received money from the injured party as the price for the purchase of the secondhand agricultural machinery, he purchased the secondhand agricultural machinery, repaired it, and has no intention or ability to divide part of the profits into the injured party.

Nevertheless, the Defendant: (a) by deceiving the victims as above; (b) by deceiving the victims on seven occasions during the period from January 1, 2016 to August 25, 2016; (c) obtained KRW 20 million from April 8, 2016 to receive KRW 9 million from around the 151,300,000 for the total amount of KRW 151,30,000 from the victims, as shown in the crime list, as shown in the attached Table, from January 2016 to August 25, 2016.

2. On September 2016, 2016, the Defendant: (a) requested a victim F to sell a Poke (LGX100) Poke (LGX100) owned by the Defendant from the victim F on behalf of the Defendant; (b) sold the said Poke (1) to the name-disscepted person at KRW 6 million; and (c) used the said Poke for the victim’s personal debt repayment, etc. at around that time, the Defendant embezzled the said Poke for the victim.

1. On October 2015, the Defendant committed the crime against the Victim G, saying, at the victim’s house located in Hacheon-si, the Defendant expressed that he would bring the Track to a good Tracker and exchange it with a good Tracker.

However, even if the defendant receives a track from the damaged person, he/she shall dispose of it in another place and use the proceeds to pay his/her personal debt.
