Reasons
Punishment of the crime
1. The Defendant did not own any property, and was serving as public interest service personnel at a vehicle registration office, and thus, the Defendant did not have any intent or ability to repay the loan even if he purchased a motor vehicle under the name of the victim C.
On June 2013, the Defendant: (a) made a false statement to the victim before the Gyeong-dong Office of the Gyeong-dong Office of the Gyeong-dong Office of the Gyeong-si, Gwangju; (b) made a loan of KRW 21,400,000 to the victim’s name after obtaining a certificate of personal seal impression, resident registration certificate, driver’s license, copy of passbook, and seal imprint; and (c) purchased the NAS car in the name of the victim under the name of the victim; (d) purchased the NAS car in the name of the victim before the victim’s residence in Gwangju-si; and (e) obtained the NAS car from the victim in front of the victim’s residence in Gwangju-si, Gwangju-si.
B. On June 3, 2013, the Defendant made a false statement to the victim before the victim’s residence in Gwangju City, stating that “The Defendant would make a purchase of a motor vehicle through installment financing of a motor vehicle by temporarily lending his/her name, and make use of money.” The Defendant received a certificate of personal seal impression, resident registration certificate, driver’s license, copy of passbook, and seal impression from the victim, and obtained a loan of KRW 33.6 million in the name of the victim from the Hyundai Capital Co., Ltd., Ltd., and purchased the Fland Kapoon in the name of the victim, and then acquired a pecuniary benefit equivalent to the above loan from the victim before the victim’s residence in Gwangju City on July 3, 2013.
2. Violation of the Automobile Management Act;
A. On December 6, 2013, the Defendant removed the seals of the registration license plate of the DNS CF car from the front parking lot in front of the Defendant’s residence located in G in Gwangju-si, and then the registration license plate is installed.
