A person shall be punished by imprisonment with prison labor for not less than 8 months for the crimes of Nos. 2 and 3 as stated in the judgment of the defendant, and by imprisonment with prison labor for not more than 4 months.
Reasons
Punishment of the crime
On June 8, 2011, the Defendant was sentenced to one year of imprisonment with labor for a violation of the Punishment of Tax Evaders Act at the Seoul Western District Court, and the said judgment was finalized on June 16, 2011. On March 27, 2013, the Seoul Western District Court sentenced two years of suspension of execution to eight months of imprisonment with labor for a crime of fraud, and the said judgment became final and conclusive on April 4, 2013.
1. Around July 2, 2008, the Defendant: (a) around July 2, 2008, the Defendant provided the victim’s (ju) G Office operated by the Victim F with the second floor 1414 of the building, Geumcheon-gu Seoul, Geumcheon-gu, Seoul, that “The Defendant provided KRW 42,00,000,000 for 110 for stud sttel of the Y-gu Y-gu Y-gu YY-gu YY-gu YY-gu YY-gu YY-gu YY-gu YY-gu YA. As such, the Defendant would pay the price of the goods within 15-20,000 won from the date of receipt of the goods if the 110th TV was supplied.”
However, the Defendant had had no intent or ability to pay the price of the goods normally even if the said TV was supplied, and the said payment guarantee was forged.
Around July 18, 2008, the Defendant supplied 25 LROM TVs equivalent to the market price of 24,062,500 won by the victim, and acquired 45 LTVs equivalent to the market price of 43,312,50 won by the Defendant around the 25th day of the same month.
2. On October 19, 2012, the Defendant: (a) ordered the J to purchase a vehicle under the name of K on behalf of the Defendant on behalf of the Defendant; (b) requested the Hyundai Capital Co., Ltd. to allow installment payments; and (c) issued K’s certificate of personal seal impression, resident registration certificate, etc. to the said J.
However, there was no consent from the above K to purchase the vehicle in its name.
Upon the request of the above defendant, the above JJ is K7. K7. at the Aeronautical Motor Agency in Ansan-si, 541-3, the members of Ansan-si on October 19, 2012.
