A defendant shall be punished by imprisonment for a term of one year and four months.

Punishment of the crime

1. "2019 Highest 5484";

A. At around August 21, 2019, around 21:20 on August 12, 2019, the Defendant: (a) stolen the victim’s cash 300,000 won on the victim’s own, which was opened up on a simple table, with a single smartphone in the city where the victim’s cash was set up.

B. Around 05:00 on August 17, 2019, the Defendant embezzled the gallon 100,000 of the market price owned by the victim F on the front road of Osan City, where the victim F was lost, without following necessary procedures, such as acquiring gallon 10,000 won of the market price and returning the gallon 6,70,000 won of the market price to the victim.

C. Around August 17, 2019, the Defendant paid 790,000 won to the Defendant’s online game account at H’s online game site in eight times from that time to 05:02 of that day, as shown in the attached Table of Crimes, using a cell phone from the victim F, as described in the above paragraph (b), using the cell phone from the victim F, which was acquired as described in the above paragraph (b).

Accordingly, the defendant acquired property benefits equivalent to 7,90,000 won by inputting or altering information without authority to the information processing device, such as computer, etc.

2. "2019 Highest 5598";

A. A. On July 5, 2019, the Defendant: (a) around July 5, 2019, up to July 5, 2019, embezzled without following necessary procedures, such as acquiring one cell phone of KRW 980,000,00 from the market price owned by the victim J of the victim, and returning it to the victim, in the smoking zone prior to the convenience store located in O.S., O.; (b) around July 10, 2019, the Defendant committed the crime without following necessary procedures, such as acquiring one cell phone of KRW 9,00,00,000 from the market price owned by the victim in front of the lag site located in K in O.S., O. on or around July 10, 2019.
