Reasons
Punishment of the crime
1. On November 16, 2006, Defendant A was sentenced to imprisonment for a violation of the Punishment of Violences, etc. Act (a violation of the Act on the Punishment of Violences, etc.) at the Changwon District Court on February 20, 2009, and the execution of the sentence was terminated on February 20, 2009. On December 13, 2012, Defendant A was sentenced to imprisonment for a violation of the Punishment of Violences, etc. Act (a violation of the Act on the Punishment of Violences, etc.) and the said judgment became final and conclusive on March 29, 2013.
On February 20, 201, the Defendant: (a) on February 20, 201, around 22:00, Gano-si in Kimhae-si, and (b) on February 20, 201, Gano-si, together with 15 illness and 2 female employees, carried out alcohol equivalent to 1.20,000 won; and (c) on February 20, 201, the Defendant attempted to give money to the victim H (the age of 54) who is the said singing-si business owner, and tried to give money.
Therefore, on the ground that the victim's "the third, the present, and the present, should not be able to perform funeral services" and that the settlement of the drinking value is demanded, it threatens to create a bad appearance of violent nature, "I do not believe or be able to believe or be able to do so........", and if the drinking value is continuously demanded, I saw that it would cause any danger and injury to the victim so that the victim may no longer claim for the drinking value.
The defendant, as such, has the victim frightened with the victim and frighten with 1.20,000 won of drinking value, and in the same manner, the defendant frightened the victim.
