A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant violated the Resident Registration Act by advertising that he holds the resident registration certificates of B, who is the birthee, was willing to withdraw and use the savings insurance purchased in B’s name, and was willing to receive a re-issuance of passbook in B’s name.

On December 7, 2015, the Defendant applied for the re-issuance of passbook B at a post office located in the Nam-gu Busan Metropolitan City, Busan Metropolitan City, and presented B’s resident registration certificate as above.

The Defendant unlawfully used another person’s resident registration certificate as such.

2. Fraud;

A. On December 7, 2015, the Defendant: (a) called the victim C Co., Ltd. by phone called to the victim C Co., Ltd.; and (b) filed an application for withdrawal of the E Savings Insurance subscribed in B’s name, i.e., B’s personal information as he/she was his/her birth.

The Defendant, by deceiving D as such, received KRW 5 million from that time to the post office account in the name of B managed by the Defendant on the same day from the victim company, and acquired KRW 1,059,000 from that time to December 27, 2016, a total of 15,059,000,000 from that time, as shown in the separate crime list, from that time.

B. On January 2016, the Defendant: (a) called the victim’s telephone at a closed place; (b) requested the victim’s company to cancel the F health insurance policy, which was subscribed in B’s name, and applied for the payment of the termination refund.

On January 25, 2016, the Defendant deceivings the above employees under the name of the above, and acquired 758,280 won from the victim company to the post office account in the above B as a refund for termination of the insurance contract on January 25, 2016.

3. Forgery of private documents, uttering of falsified investigation documents, and violation of the Resident Registration Act.
