피고인은 2019. 5. 9. 21:10경 창원시 진해구 C아파트 D동 앞 주차장에서, 피해자가 자신을 피하며 만나주지 않는다는 이유로 피해자에게 “죽여 버린다. 너거 집에 불 질러 버린다.”고 하면서 겁을 주고, 양손으로 피해자의 목을 조르고, 왼쪽 뺨을 2회 때렸으며, 발로 왼쪽 허벅지를 약 2회 찼다.
