1. Defendant A shall be punished by imprisonment with prison labor for one year and four months;
2. Defendant B shall be punished by a fine of KRW 1,00,000.
Reasons
Punishment of the crime
1. A business owner who operates a child-care center that meets the requirements for subsidization of expenses incurred in vocational skills development training by entrusting infant-care teachers to a training institution for vocational skills development training, may receive subsidies from the Human Resources Development Service of Korea for an amount equivalent to the training expenses paid, and in order to receive subsidies, infant-care teachers who are trainees shall attend at least 80/100 of the training hours and complete the training course;
2. Defendant A related to the public offering is a child-care center operator operating the “G Lifelong Education Center”, which is the aforesaid vocational ability development training institution, from the Gu F during Gyeyang-gu to October 2014. Defendant B is a child-care center operator operating the “I child-care center” under “I child-care center” under “I child-care center” under 105 Dong 104, Ansan-gu, 2010.
Defendant
During the period of operation of the above G Lifelong Education Center, A proposed to the effect that “The employer of the above G Lifelong Education Center, including Defendant B, will be able to receive subsidies by treating it as being present even if the child care teacher does not attend the training,” and the above employer of the child care center provided the Defendant A with the necessary teaching tools for the certification of the child care center, and accepted the Defendant A’s proposal.
3. The Defendant: (a) around November 17, 2013, at the G G G lifelong Education Center; (b) Defendant A submitted a false document to the employee in charge of the Human Resources Development Service of the victim as if he/she appeared at least 80/100 of the training hours at the G G lifelong Education Center, despite that he/she did not attend at least 80/100 of the training hours at the G lifelong Education Center, Defendant A had the victim paid KRW 43,00 as subsidies for the training expenses at around January 3, 2014; and (c) from July 27, 2013 to January 23, 2015.
