The defendant shall be innocent.
Reasons
1. The Defendant of the facts charged in the instant case shall not operate a motor vehicle on the road, which is a holder of Cone Star, and which is not mandatory insurance.
Nevertheless, at around 18:53 on December 10, 2008, the Defendant operated the said van, which was not covered by a mandatory insurance, at the entrance of the Jin-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-si, as indicated in the list of crimes in the attached list of crimes.
2. Determination
A. The Defendant and his defense counsel’s assertion is merely a fact that the Defendant driven the instant vehicle on behalf of the Lone Star Co., Ltd. (hereinafter “instant vehicle”) indicated in the facts charged at the request of friendly D and did not operate the instant vehicle as indicated in the facts charged.
B. According to the evidence of judgment, the Defendant’s driving of the instant vehicle on July 18, 2009 and June 5, 2010, controlled the violation of safety belts and bus exclusive lanes, and issued a penalty notice to the Defendant, and the Defendant’s father received the penalty notice and paid it.
However, according to the following facts or circumstances acknowledged by the record, i.e., that the defendant-friendly appearance D held the instant vehicle as a collateral, and that there is no fact that it was lent to the defendant (the investigation record 22 pages), and ii) according to the list of crimes in the attached Table, the main place in which the instant vehicle was operated is known and tent, and there is no fact that the defendant transferred the instant vehicle at the time of being recorded in the list of crimes. On the other hand, D appears to have resided at the time of the transfer of the instant vehicle to the new town-dong-dong, Chungcheongnam-gu, Seoul Special Metropolitan City on December 24, 2009 and moved to the new town-dong, Do-si on May 27, 2010, and 3) during the above period in which D had resided at the time of the entry into the National Assembly in the list of crimes (attached Table 148, 150, 161, 146, 176).
