Reasons
Punishment of the crime
The defendant 2017 Highest 602 is the D representative in Boli-si C, who employs 15 full-time workers and provides medical care and protection services.
1. An employer in violation of the Minimum Wage Act shall pay workers subject to the minimum wage at least the minimum wage determined and publicly notified each year by the Minister of Labor, and shall pay wages at least the hourly minimum wage of at least 4,580 won per hour during the period from January 1, 2012 to December 31, 2012, at least 4,860 won per hour during the minimum wage period from January 1, 2013 to December 31, 2013, at least 4,860 won per hour during the period from January 1, 2014, at least 5,210 won per hour during the period from January 1, 2014 to December 31, 2014, and at least 5,580 won per hour during the period from January 1, 2015 to December 31, 2015.
Nevertheless, the Defendant paid wages of less than the minimum wage to 27 workers, such as the daily list of crimes (10 to 36 pages) in attached Form 2, from August 2012 to August 2015, 2015, when paying the hourly wage of 2,426 won below the minimum wage, to E retired from the said workplace as from May 10, 201 to June 6, 2014.
2. Violation of the Labor Standards Act;
(a) When a worker dies or retires, the employer shall pay the wages, compensations, and all other money or valuables within 14 days after the cause for such payment occurred;
Nevertheless, as described in the above paragraph 1, the defendant paid 1,250,00 won per month to E from August 2012 to March 2013, 2013, and paid 1,350,000 won per month from April 2013 to May 2014, and did not pay 18,705,364 won per year of below the minimum wage and 1,92,640 won per year of unused allowances within 14 days from the date of retirement, as described in the attached crime list (10-36 pages), including 1,3,4,6-4,6-8,10,12,15,17 through 27, and 17,000 won per year and 1,96,00 won per year of the minimum wage per year, as stated in the list of crimes (10-36 pages).
