1. The Defendant, in sequence, shall each point of 10, 12, 5, 11, and 10 of the annexed drawings among the land size of 247 square meters in Echeon-si, Leecheon-si.

1. Facts of recognition;

A. D completed each registration of transfer of ownership on September 14, 1987 with respect to the land No. 1 in this case and the land No. 1,010 square meters E in Ischeon-si (hereinafter “the land No. 2 in this case”) on September 15, 1987.

B. On November 1, 1987, the land category of No. 2 was changed to a gas station site. D newly constructed a reinforced concrete structure sloping roof 203.64 square meters on the ground of the above No. 2 land. Fire-proof walls (hereinafter “instant fire-proof walls”) was installed in the vicinity of the boundary with the land No. 1 adjacent thereto. On the ground of the above No. 2 land, 5 oil storage tanks were laid underground near the boundary with the above land, and around August 29, 2003, on the ground of the above No. 2 land, the land No. 2 was extended to 29.7 square meters on the ground of the above land.

E. On March 2, 2005, the Defendant completed each registration of ownership transfer on the land No. 1 and the building of the rest room of this case based on the sale on the same day.

F. According to the court’s entrustment of measurement and appraisal, the fire wall of this case is installed on the line connecting each point of the items indicated in the annexed drawing Nos. 10, 11 among the land No. 1, and based on this, the part to be able to perform maritime affairs connected with each point of the above No. 1 among the above land No. 1, the same drawing No. 10, 12, 5, 11, and 10 (hereinafter “the part to be registered among the land No. 1”), shall be gas station the area of which is 18 square meters.
