A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On December 28, 2010, the Defendant was sentenced to a suspended sentence of two years on October 10 for fraud, etc. at the Suwon District Court Sejong Housing Site Board, and the judgment became final and conclusive on January 4, 201.
1. The Defendant, on August 1, 2007, by acquiring the name of election funds from the Defendant on the restaurant of “E” operated by the victim C in Guro-gu Seoul Special Metropolitan City on August 1, 2007, through “E”, the Defendant is serving as the chief executive officer of the Central Election Management Commission, and the president of GH is a large amount, and the GI adviser is a small amount of 50 billion won. However, although the defendant was involved in election campaign while being in a political party's non-party organization, he did not have official position in the political party, and did not have a friendly relationship with H and I, so there was no promise to receive political funds in installments.
Accordingly, the defendant was delivered 18,600,000 won by deceiving the victim.
2. On January 1, 2008, after the completion of the presidential election in 2007, the Defendant acquired money under the name of the expense, the victim C from the above "E" restaurant "E" to the effect that "G party adviser I is under investigation by the prosecution and needs money to solve this problem. If the money is lent, the Defendant would receive and repay the political fund from the victim who believed the end of the election." The Defendant stated that "I will receive and repay the political fund from the G party" shall be paid from the victim who believed the end of the election on January 18, 2008, and on February 3, 2008.
