Reasons
Punishment of the crime
The Defendant, along with AH, is a person who is engaged in computer work for the fluorization of large-scale non-defluorious funds of former high-ranking political parties, along with one person’s own Cheongdae and one person’s own Cheongdae and one person’s own Cheongdae, as if he had a friendly relationship with AH.
1. On October 8, 2014, the Defendant acquired the name of the borrowed money from the victim AK in Seocho-gu Seoul Metropolitan Government, the Defendant made a false statement to the effect that “AL restaurant operating the Seocho-gu Seoul AK would lend KRW 30 million to the victim with the interest and pay the victim immediately after the date on which the loan is made.” The Defendant asked the victim for the reason that “30 million won will be asked as to whether it is money and will bring about the match.” The Defendant made a false statement with the interest of a large amount of money.
However, the defendant had no intention or ability to pay the money with interest on the following day even if he/she borrowed the money from the victim due to the lack of any special property or profit to be used for the purpose of AH.
In collusion with AH, the Defendant, by deceiving the victim as above, received 30 million won from the victim to the new bank account (number : AM) used by AH, and acquired it by fraud.
2. On October 2014, the Defendant acquired the name of the conversion of the non-financial name of Blue House 38 trillion won by fraud to the effect that “The facts are doing computer work to support AI working in Blue House and to 38 trillion won of the former president’s non-financial funds, and time takes place for computer work” to the victim who demanded the Defendant to repay money in the above AL restaurant.
At that time, the Defendant continued to lend necessary expenses to the effect that “I will return the proceeds after the completion of computer work,” and AH had shown the application for a new bank exchange remittance stating that “I will return the proceeds to I would return the proceeds after adding them to the proceeds.”
