피고인은 2014. 7. 24. 21:40경 청주시 흥덕구 C에 있는 ‘D’ 편의점 앞에서, 주취자인 피고인이 도로가에 누워 있어 위험하다는 112 신고를 받고 출동한 청주흥덕경찰서 E지구대 소속 경위들인 피해자 F, G에게, H 등 여러 사람이 지켜보는 자리에서 “야, 씨발놈들아, 니들이 뭔데 지랄이야, 내가 여기서 자든 말든 니들이 뭔 상관이야 개새끼들아, 경찰이면 다야, 내가 뭘 잘못했다고 그래 씹새끼들아“라고 큰소리로 욕설하여 공연히 피해자들을 모욕하였다.
