1. Facts of recognition;

A. Under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”), the Plaintiff is a cooperative established to implement a housing reconstruction improvement project by using the area of 68,225.8 square meters as a rearrangement zone in Jung-gu Seoul Metropolitan Government pursuant to the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”). The Plaintiff obtained authorization for the establishment of an association on September 4, 2008 from the head of Jung-gu Seoul Metropolitan Government

X로부터 이 사건 건물 1층 중 별지2 도면 표시 ⓐ, ⓑ, ⓒ, ⓓ, ⓐ의 각 점을 순차로 연결한 선내 (가) 부분 143.36㎡(H)를 임대차기간 2008. 2. 11.부터 2010. 8. 10.까지, 보증금 3,000만 원, 월 차임 250만 원으로 정하여 임차하였고, 피고 C는 X로부터 이 사건 건물 3층 중 별지3 도면 표시 ⓔ, ⓕ, ⓖ, ⓗ, ⓔ의 각 점을 순차로 연결한 선내 (나) 부분 112.2㎡(I)를 임대차기간 2014. 5. 15.까지, 보증금 2,500만 원, 월 차임 132만 원으로 정하여 임차하였으며, 피고들은 당심 변론종결일까지 위 각 건물 부분(이하 ’이 사건 각 점유부분‘이라 한다)을 점유하고 있다.
