A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2015 Highest 2709] The Defendant, around February 16, 2015, posted a notice to the Defendant’s residence in Busan Northern-gu C and 102 Dong 1203, stating that the Defendant would sell an Internet NAVER 'Meata' website using a mobile phone, and then send '305,000 won when sending '305,00 won to the victim D who reported and contacted it.'

However, since the defendant did not have a ductal sches, even if he received the money for the new sches from the victim D, he did not have the intention or ability to send the said new sches.

The defendant received 305,000 won from the victim D to the Busan bank account (E) in the name of the defendant on the same day as the price for goods, and acquired it through the money, and the same year from that time.

4. By December 22, 25, the victims received total sum of KRW 8,515,000 from the victims to the Busan Bank account in the same way as stated in the attached Table 1.

around April 19, 2015, the Defendant sent a letter to the effect that “the victim F will purchase an open pop fishing age” on the Internet NAVER C and 102 Dong 1203 at the Defendant’s residence, and that “the victim F will send the fishing age to the home-to-house will first deposit the price of the goods.”

However, since the defendant did not have the above fishing age, there was no intention or ability to send the above fishing age even if he receives the goods from the victim.

The Defendant received 140,000 won from the victim F to the Busan Bank account (G) in the name of the Defendant on the same day from the victim F, and the same year from that time.
