그럼에도 피고인들은 위 게임장의 운영자인 G과 공모하여 2011. 10. 13.경부터 같은 달 20. 15:30경까지 위 게임장에서 게임물등급위원회로부터 등급을 받은 '일대백' 게임물에 일명 ‘똑딱이’를 설치하여 게임을 하는 사람이 게임기 버튼을 통하여 게임물을 구동하지 아니하고, ‘똑딱이’를 통하여 게임기가 자동으로 구동되도록 하는 방법으로 등급을 받은 내용과 다른 내용의 게임물을 손님들의 이용에 제공하고, 손님들이 게임을 통하여 취득한 5,000원권 경품을 수수료 10%를 제한 후 현금 4,500원으로 환전해 주었다.
