A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

The defendant is a foreigner of Russian nationality, who enters the Republic of Korea on August 18, 2016 and stays illegally in the Republic of Korea on and after October 17, 2016.

1. The Defendant, i.e., joint criminal conduct (special larceny) with a name-free box (one name “B”), a foreign person (one name “B” and the same day’s stay of prosecution) and the department store (one day’s stay of prosecution), and had a mind to steal things displayed in a store where surveillance was neglected.

Around 15:54 on December 5, 2018, the Defendant and the above-mentioned names in the middle-gu, Daegu, Daegu, using the gap in which the victim's attention was neglected in the first floor F store in the E department store located in the large area of the E department store managed by the victim D, the Defendant reported the network, and the above-mentioned names in the above-mentioned names were put into the bank where the victim's market value was 1,550,000 won in total, and one wall was prepared in advance.

As a result, the defendant and the above-mentioned person who did not know the name of the victim were stolen by 4,679,000 won in total on three occasions from that time to that of the same month, as shown in attached Table 1.

2. The defendant's sole criminal conduct;

A. On December 2018, the Defendant: (a) around 2018, the second floor of the I store managed by the victim H in Daegu Seo-gu G, the Defendant used a gap in the victim’s attention; (b) brought the victim’s attention into a bank prepared in advance to be filled in the display stand equivalent to KRW 9,800 in the market price of the 9,800 in the display stand; and (c) from around that time to March 13, 2019, the Defendant brought the victim’s property worth KRW 322,340 in total twice as shown in the attached Table 2 of the Crimes Day.

Accordingly, the defendant stolen the victim's property.

B. On March 27, 2019, the Defendant attempted to larceny: (a) at L administered by the Victim K in the Daegu-gu J around 19:29, the sum of the market prices of the victim’s crepits, such as business in the display belt, is equivalent to 53,450 won.
