Punishment of the crime
In fact, the Defendant attempted to remodel a hotel in Uzbekistan around 2008 and 2009, but did not start a hotel remodeling business because of no funds, and even if the Defendant borrowed money from others because there was no particular revenue or property such as default on payment, etc. while carrying out export-related business around 2008, there was no intention or ability to repay the money, the Defendant, along with the mother D, intended to receive and use the money as if the Defendant is promoting a hotel remodeling business in Uzbekistan.
1. Around May 20, 201, at the victim F’s house located in Gangnam-gu Seoul Metropolitan Government, D makes a false statement to the victim that “A child is doing business to remodel a hotel in Uzbekistan, but the cost of an infant’s flight aircraft needs to be loaned KRW 3 million as he/she needs to do so,” and the Defendant made a telephone call with the victim that “a project to remodel a hotel shall be carried out. A mother will give money to his/her mother and send KRW 3 million to him/her.”
In collusion with D, the Defendant received KRW 3 million from the victim to the account in the name of the female-born G, the Defendant was transferred from the victim.
2. Around June 17, 2011, D at the same place reads to the victim F that “I would pay without money if I would lend money because I would not have good financial conditions to remodel a hotel in Uzbekistan,” and the Defendant stated to the victim that “I would like to find out that I would have come into a commercial bank, if I would like to find the start money for remodeling works of the Uzbekistan hotel, I would have to lend to the victim the deposit amount of KRW 10 million as I would need to pay if I would have come to the commercial bank.”
In collusion with D, the Defendant received 4.5 million won from the victim to the account in the G name.
3. D at the same place around October 12, 2011, means money to the victim F to the victim F that the circumstances of funds would not be good for children to implement hotel remodeling works in Uzbekistan.
