A defendant shall be punished by imprisonment for not less than one year and six months.

The defendant shall be liable to the applicant C for the damage KRW 500,000,000.

Punishment of the crime

On January 4, 2018, the Defendant called “The 2018 Highest 54” that “The Defendant would sell 2 80,000 won or more to the victim Q Q by contact with the victim Q.”

However, since the defendant did not have a ticket to sell, there was no intention or ability to sell the ticket even if he received money from the injured party.

As such, on January 4, 2018, the Defendant, by deceiving the victims, received 280,000 won from the victim’s bank account (R) in the name of the Defendant on deposit on January 4, 2018. From that time, the Defendant deceivings the victims on a total of 17 occasions as shown in attached Table 1 re-elections until February 8, 2018, and received a total of 11,930,000 won from the victims.

On January 16, 2018, the Defendant made a false statement to the victimO that “The Defendant would sell 2 boxes of Pyeongtaek Chang Olympic Games shock and ice rink 2 in KRW 700,000” through the NAV Kafa in the Blue area below Daejeon on January 16, 201.

However, since the defendant did not have a ticket to sell, there was no intention or ability to sell the ticket even if he received money from the injured party.

Nevertheless, on January 16, 2018, the defendant deceivings the victim as above and received 700,000 won from the victim's bank account (R) under the name of the defendant on January 16, 2018. From January 1, 2018 to February 11, 2018, the defendant deceivings the victims by the same method five times in total, as shown in the attached Table 2 of the List of Crimes. The defendant was paid 4,523,000 won in total from the victims.

"The Defendant, on November 8, 2017, 2018, 2017, hereinafter referred to as "the Defendant, with access to the Internet NAV and the Republic of Korea, reports on the purchase of third parties made by the Victim S by accessing the Internet NAV and the Republic of Korea, shall contact the victim and send back money to the designated account."
