A defendant shall be punished by imprisonment for not less than eight months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

At a construction site located in the Republic of Korea, if there is a certificate of completion of basic health education for construction business under the Occupational Safety and Health Act, it is easy to find employment.

Although the Defendant was employed at a construction site in the Republic of Korea by usual China and the Republic of Korea as a person engaged in the sale of cosmetics, the Defendant offered a false entry into a construction site, upon the request of a Chinese person who is unable to receive basic education on construction business, to forge the certificate of completion from the Chinese person who is unable to receive basic education on construction business, and offered to return the forged certificate to the Chinese person.

1. The defendant's name unclaimed boxes and co-offenders with B;

가. 피고인은 2019. 7.경 전북 완주군 C에 있는 아파트 건설현장 부근에 있는 중국 식품점에서 B으로부터 ‘중국에 가게 되면 건설업 기초안전 보건교육 이수증을 만들어 가져다 달라’는 부탁을 받고, 2019. 8. 22.경 중국 다롄시로 건너가 성명불상자에게 위 이수증 위조를 의뢰하였다.

성명불상자는 그 무렵 위 장소에서 종류를 알 수 없는 컴퓨터 응용 프로그램을 이용하여 건설업 기초안전 보건교육 이수증 양식에 B의 증명사진을 붙이고 이름란에 ‘B’, 생년월일란에 ‘D’, 등록번호란에 ‘E’, 이수날짜란에 ‘2019.02.28.’, 발급자 명의란에'F㈜'라고 작성하고 그 직인을 표시한 후 컴퓨터에 연결된 카드 발급기에 공플라스틱 카드를 넣고 출력하여 이를 2019. 10. 25.경 중국 다롄시 이하 알 수 없는 장소에서 특급 EMS 우편으로 피고인에게 발송하였다.

Accordingly, the defendant, in collusion with the name-free boxes and B, has forged a certificate of completion of basic health education in the name of FB, a private document concerning certification of facts without authority.
