The dismissal of the respondent on December 5, 2008 against the applicant shall be suspended until the judgment of the Seoul Administrative Court 2008Guhap49513 became final and conclusive.
Reasons
신청인이 제출한 소명자료에 의하면, 주문 기재 처분의 집행으로 인하여 신청인에게 생길 회복하기 어려운 손해를 예방하기 위하여 긴급한 필요가 있다고 인정되고, 달리 위 집행정지로 인하여 공공복리에 중대한 영향을 미칠 우려가 있는 떄에 해당한다고 인정할 자료도 없으므로, 행정소송법 제23조에 의하여 주문과 같이 결정한다.
