1. Defendant B’s KRW 11,00,000 as well as 5% per annum from February 2, 2018 to January 23, 2019, respectively, to the Plaintiff.
Reasons
1. Article 2 (Lease Deposit, Rent, etc.) 1) The deposit daily amount of KRW 100 billion ( March 21, 2017), rents, etc. shall be determined as follows:
(1) The monthly rent (excluding value-added tax) shall be the 30th day from the date of commencement of the hospital, and the monthly rent and management fee shall be the same day as the first day of each month.
Article 3 (Duration) The duration of the lease shall be two years from the date of the conclusion of this contract.
Article 4 (Non-Payment of Rent, Management Expenses, and Expenses) If a lessee fails to pay rent, management expenses, and ice within the fixed date, the lessor shall pay the amount in arrears plus 2% of the amount in arrears at the rate of 2% per month from the following day to the date of full payment.
Article 17 (Special Arrangement Clause) 1) The sub-lease of the medical business and the same type of business shall be allowed if it conforms to the purpose of this medical business. A. (1) From the date immediately following the conclusion of the contract, the rent, etc. under Article 2 (1) of the Act on the Operation of a Hospital, such as sexually off, etc., from the leased object of the instant case shall be determined as follows: (i) monthly rent of KRW 10 million (excluding value-added tax) shall be the date on which the 90th day from the date of the date of the hospital, and the monthly rent and management fee shall be the same as the first day of each month.
