1. The Defendant’s KRW 23,201,753 as well as the Plaintiff’s KRW 5% per annum from August 15, 2013 to December 29, 2014.
Reasons
1. Basic facts
A. On July 5, 2012, the Plaintiff leased the second floor (hereinafter “instant building”) of the Gangnam-gu Seoul Building (hereinafter “instant building”) to the Defendant on the basis of deposit KRW 30 million, monthly rent of KRW 3 million (excluding value-added tax), monthly management fee of KRW 500,00 (excluding value-added tax), monthly management fee of KRW 500,00 (excluding value-added tax), and the lease period from July 5, 2012 to May 31, 2014 when the individual notice of public charges, such as electricity charges, water charges, and gas charges, is given separately, and if the lessor requests a divided distribution, it shall be paid with the rent and management fee.
The lease of this case is referred to as the "lease of this case"
B) B. However, the Defendant paid only KRW 5 million with the deposit of the instant lease, KRW 10 million on July 5, 2012, and thereafter, paid KRW 10 million on July 31, 2012. The remainder of the rent, management expenses, and public charges, etc. were overdue upon the payment of the rent of KRW 3 million on August 2012. (C) Accordingly, the Plaintiff notified the payment of the rent on October 8, 2012 and December 13, 2012, but the Plaintiff refused to pay the unpaid rent of KRW 10,00,000,000,000,000,000,000,000,000,0000,000,000,0000,000,000,0000,000,0000,000,0000,000).
2. Determination
A. According to the facts of the judgment on the plaintiff's cause of claim, the defendant's appeal is reasonable as to the existence and scope of the defendant's obligation from August 15, 2013 to December 29, 2014, where it is recognized that it is reasonable for the defendant to dispute as to whether the defendant's obligation exists and its scope as to the unpaid amount of KRW 23,201,753 [the unpaid amount of KRW 33,201,753 (the unpaid amount of KRW 561,650,000 for the unpaid amount of public charges of KRW 561,043) and the unpaid amount of electricity charges of KRW 1,00,000 for the unpaid amount of KRW 1,00,000,000 for the plaintiff.
