A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. From May 3, 2016 to the same month
4. Purchasing and medication campophophones (one-person clopphones; hereinafter referred to as “copphones”);
A. On May 3, 2016, the Defendant: (a) decided to purchase a penphone from a person whose name is unknown through a smartphone hosting display; (b) transferred KRW 400,000 to an account used by a person whose name is unknown at C convenience store located in the Seo-gu Incheon, Seo-gu, Incheon at around 20:00 on May 3, 2016; (c) around 23:00 on the same day, the Defendant sent approximately one gram of a penphone in front of the “E branch” located in Seo-gu Incheon, Seo-gu, Incheon.
B. At around 00:20 on May 4, 2016, the Defendant injected a approximately 0.5g of the penphones purchased from the Defendant’s house located in Jung-gu Incheon Metropolitan City F on the gambling place, putting about approximately 0.5g of the penphones purchased as above on the gambling place, and inhales them by burning them with a premiumter.
C. At around 02:30 on May 4, 2016, the Defendant injected approximately 0.3g of the philophones purchased at the above Defendant’s house, and inhaled them by heating them with a drama, and injected them.
At around 03:30 on May 4, 2016, the Defendant, at the above Defendant’s house, laid approximately 0.2g of the philophones purchased as above, on a gambling ground, inhaled smokes generated by burning them by heating them with a logter.
2. Purchase and medication of philophones from May 20 to May 21, 2016;
A. On May 20, 2016, the Defendant: (a) decided to purchase a penphone from a person whose name cannot be known through a smartphone hosting display; (b) transferred KRW 400,000 to an account used by a person whose name cannot be known at the above C convenience store at the above C convenience store at around 17:30 on May 20, 2016; (c) on the same day, at around 19:09, the Defendant sent the above name to a person who was not known at the street above the above E branch by Kwikset service delivery officer, approximately one gram of the phonephone contained in a vinyl.
B. At around 21:00 on May 20, 2016, the Defendant ambling about 0.25g of philophones purchased at the above Defendant’s home.
