Defendant
A shall be punished by imprisonment with prison labor for six months and by imprisonment with prison labor for ten months.
However, the two years each from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On September 2013, Defendant A conspired with the introduction business entity E and the business owner G of F of the main repair business entity, Defendant A installed a program altered to enable G to be distributed to C’s gas station at approximately five per cent of the actual liquor flow, and altered measuring instruments with a view to manipulating measurement values.
2. Defendant B
A. Defendant B, in collusion with the introduction business entity E, the main business owner G of the main amusement repair business entity F, etc. on September 2013, in violation of the CP law and the Petroleum and Petroleum Substitute Fuel Business Act, installed the altered program in the main 9 keyboards for less than 5% of the actual liquor flow to G around September 2013, and the Defendants used the altered program to approximately 5% of the actual liquor flow to customers from around that time to February 6, 2014.
As a result, Defendant B altered measuring instruments in collusion with E, G for the purpose of manipulating measurement values, sold petroleum or petroleum substitute fuel in excess of 0.75% 【 150ml) of the usage vehicle as prescribed by the Presidential Decree, and remodeled business facilities for the purpose of selling below the fixed quantity.
B.
