The Defendant-Counterclaim Plaintiff (Counterclaim Plaintiff),

A. As to KRW 41,600,000 and KRW 27,200,00 among them, to Plaintiff (Counterclaim Defendant) A.

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Basic facts

A. The defendant is a stock company established for the purpose of job offering and job seeking, online information provision business, etc. through the Internet, and operates the "D (E)", which is advertised as a shopping mall sub-business or business start-up website, and the plaintiffs join D around July 2018 and have engaged in activities such as attracting D's new members.

B. 1) A member of D is divided into five stages, namely, the method of paying D’s revenues, according to the amount of admission fees paid to the Defendant at the time of joining. If D’s new member applicants after joining D’s membership, and the applicant enters D’s membership and made the applicant enter D’s membership, the amount of the new member’s subscription fees paid to the Defendant shall be accumulated as the amount of the ar’s revenue from the ar’s recommendation, and the amount of money equivalent to the above revenue shall be deposited into the deposit account in the name of the ar’s name on the same day upon the request of the Defendant (hereinafter referred to as “instant contract”).

2) The Plaintiffs paid KRW 990,000 to the Defendant for each subscription fee of KRW 990,000, thereby joining the shoppingVIP membership, and thereafter attracting other persons into D’s new shoppingVIP membership, and each new member paid KRW 800,000 out of the subscription fee of KRW 990,000 to the Defendant.

3) The members of D including the Plaintiffs, etc. have used a method of advertising and publicizing them to SNS, etc. by photographing screen pictures on which the amount of earnings accumulated on their D IDs can be seen to attract new members to become a member. 4) The proceeds from the recruitment of members from the Defendant, and Plaintiff A from September 5, 2018 to February 11, 2019.
