A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. From January 13, 2019 to 17:40 on the same day, the Defendant interfered with the business: (a) within the “D coffee shop” operated by the victim C (Nam, 58 years of age) of the first floor of the building in Busan, Jin-gu, Busan; (b) reported that other customers E, without permission, laid the drinking and the door in a locking place on the floor; and (c) dumping the above drink into the floor; and (d) when he got the above door from the above E, the Defendant dumped it into the floor, and dump the drink, “I would like to dump the drink, for whom they would have not come back; and (d) I would like to see that E would have a defect in recovering the door; and (e) would interfere with the outside of the shop by having the victim dump with it.”
2. From February 1, 2019 to around 04:49 of the same day, the Defendant: (a) reported that a Hexton car owned by the victim G (Nam, 37 years old) is towed after a vehicle accident and parked at the same time; (b) opened a door on the part of the victim’s vehicle; and (c) cut off a smart key of 100,000 won at the market price owned by the victim, which was located in the instant instant cup, from around 04:18 to around 04:49 on the same day.
3. The Defendant was kept in a parking lot for about one month from January 1, 2019 to February 1, 2019, in a state where the front part of a vehicle is destroyed and cannot be operated due to a traffic accident that occurred on December 27, 2018, with a rater, which was owned by the Defendant on the part of the driver’s seat of the car as set forth in the above Paragraph 2, and the market price as set forth in the instant case’s record, which was not known by the Defendant. In other words, the said car was kept in a parking lot for about one month from February 1, 2019, which is the day of the crime as set forth in the judgment.
