A defendant shall be punished by imprisonment for not less than eight months and by a fine not exceeding three hundred thousand won.

Punishment of the crime

On July 25, 2013, the Defendant was sentenced to imprisonment with prison labor for 8 months and a fine of 300,000 won on July 1, 2014, for night residence intrusion larceny, occupational embezzlement, larceny, and violation of the Road Traffic Act (unlicensed Driving) in the Sungnam Branch of Suwon District Court.

1. Occupational embezzlement;

A. From May 14, 2014, the Defendant, who was engaged in food delivery and food collection business at a restaurant operated by the victim D located in Seongbuk-gu, Sungnam-si, and 1st floor, was embezzled on May 14, 2014, as a person who was engaged in food delivery and food collection business at around 200,000 won and FOba, which was collected from food for the victim on his/her business on or around 21:00 on May 14, 2014.

B. From August 16, 2014, the Defendant, who was engaged in the business of delivering food and receiving food costs at an I restaurant operated by the victim H located in Seongbuk-gu G in Seongbuk-gu, Sungnam-si, was embezzled by arbitrarily consuming 10,000 won for the personal use of living expenses, etc. around that time while he/she was kept in the business for the victim at around 11:00 on August 16, 2014.

C. From August 30, 2014, the Defendant, who was engaged in the business of delivering food and receiving food costs at L restaurants operated by the Sung-gu JJ located in Seongbuk-gu, Sungnam-si, on August 30, 2014, was embezzled as a person who was engaged in the business of selling food at food and receiving food costs at around 23:00 on August 30, 2014, and a credit card terminal amounting to KRW 250,000 on the market price, and a credit card terminal amounting to KRW 2,00,000 on the market price, while being kept for the victim, he arbitrarily consumed food costs at around that time for personal purposes such as living expenses, and embezzled credit card terminals and office phones by failing to return credit card terminals and office phones.
