A defendant shall be punished by imprisonment for three years.

Punishment of the crime

1. On January 11, 2020, the Defendant was issued a summary order of a fine of four million won at the Jeonju District Court for the crime of violating the Road Traffic Act, and the said summary order became final and conclusive on February 26, 2020.

Nevertheless, at around 05:55 on February 2, 2020, the Defendant driven a FIstm vehicle with a blood alcohol concentration of about 0.086% under the influence of alcohol from approximately 5km section from the Yansan-gu B apartment Cdong parking lot in the Jeonjin-gu, Seoul, to the front road in Jinjin-gu, Seoul.

2. Violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents (Death) is a person engaging in driving a Frocketing car.

On February 2, 2020, at around 05:55, the Defendant driven the said car under the influence of alcohol, as described in Paragraph 1, and proceeded at a speed of about 62 km at a speed of about 62 km from the right side of the G oil station to the right side of the dead Jin-gu.

At the time, it was difficult for the victim H (68 years of age) to move a bicycle on the front side of the passenger car driving direction of the defendant, and in such a case, the driver of the motor vehicle had a duty of care to prevent accidents in advance by driving the motor vehicle safely, such as checking the front side and the left side, accurately operating the steering and brake system, etc.

Nevertheless, under the influence of alcohol, the Defendant neglected to drive the said car while driving it, and failed to accurately operate the steering and steering system, and led to the Defendant’s negligence that caused the Defendant’s bicycle back wheel part on the front wheel part of the car.

Ultimately, at around 07:01 on the same day, the Defendant caused the death of the victim in an emergency room of the Jeonjin-gu University Hospital located in 20, Seojin-gu, Seoul Special Metropolitan City on the same day due to the foregoing occupational negligence.
