A defendant shall be punished by imprisonment for not less than two years and six months.

[ 전제사실] 성명 불상( 휴대 폰 어 플 ‘ 위 챗’ 대화명 : C, D, E) 들은 불특정 다수의 피해자들에게 전화한 후 검사를 사칭하는 등으로 피해자들을 속여 돈을 출금하도록 한 다음 이를 건네받는 등 속칭 ‘ 보이스 피 싱’ 방법으로 범행을 하는 조직으로, 피해자들에게 전화하여 갖가지 거짓말로 돈을 출금하도록 하는 속칭 ‘ 콜센터’, 피해자가 출금한 현금을 건네받아 위 조직에 전달하는 속칭 ‘ 수거 책’, 수거 책으로부터 현금을 교부 받아 속칭 ‘ 환치기 ’를 통해 돈을 송금하는 속칭 ‘ 환전 책 또는 송금 책’ 등으로 각각 역할을 분담하고 있고, 위와 같은 보이스 피 싱 조직은 수사기관의 검거에 대비하여 ‘ 위 챗’ 등의 휴대폰 메신저 어 플 리 케이 션을 이용하여 서로 연락하는 등 점조직 형태로 운영되고 있다.

피고인은 보이스 피 싱 총책인 성명 불상의 지시에 따라 2018. 5. 31. 오전 경 파주시 F에 있는 피고인의 집 근처 상호 불상의 PC 방에서 성명 불상이 불상 일시에 불상의 방법으로 위조하여 피고 인의 위 위챗으로 송부한 금융위원회 위원장 명의 서류( 제목 : 금융범죄 금융 계좌 추적 민원,

1. The reply to the civil petition seeking tracking a new financial account filed with the Financial Supervisory Service in its thickness;

2. The Financial Services Commission has directed the prosecutor and investigator in charge of the Seoul Central District Public Prosecutor's Office in charge of the relevant Seoul Central Public Prosecutor's Office to track the financial account in accordance with the principal measures and cooperation documents related to tracking the financial account.

3. The Financial Services Commission is required to trace the account for the passbooks and illegal funds by tracking the Hen's financial account, and after tracking the account, to take measures to dynamics and recover from the National Treasury in accordance with Article 27.3 of the Financial Services Commission Act at the time of identifying the illegal account and illegal funds, and to establish transparency in the Hen's account through tracing the account.
