A As a fine of 4,00,000 won, Defendant B’s imprisonment with prison labor of 6 months and fine of 3,000,000 won, Defendant C shall be punished by imprisonment with prison labor of 6 months.
Reasons
Punishment of the crime
1. Defendants B and C’s gambling opening opened a gambling place and allowed people to gamble, and there was a conspiracy to acquire the word “the word” under the pretext of the use of the gambling place. A.
On April 4, 2014, from around 21:00 to 06:00 of the following day, the Defendants leased the above heading room from Defendant D to Defendant D’s 515, and Defendant C prepared articles necessary for gambling, such as cards, tobacco, and drinking water. The Defendants, as prescribed in paragraph (2), did not put the participants in the above heading room to gambling, and got approximately KRW 6.50,00 won hereinafter referred to as “higher”) out of the sales amount 1 to 20,000 won.
Accordingly, the Defendants conspired to open a place for gambling for profit-making purposes.
B. From April 5, 2014 to April 22:30 on the following day, from around 01:26, the Defendants equipped with the facilities and goods necessary for gambling in the manner described in the foregoing paragraph (a) at the hotel room of 516, as described in the foregoing paragraph (a), and received approximately KRW 170,000 from a person to engage in gambling as described in paragraph (2) and acquired profits equivalent to those of approximately 170,000 won.
Accordingly, the Defendants conspired to open a place for gambling for profit-making purposes.
2. The gambling of Defendant B and Defendant A
A. Defendant B, Defendant A, along with H, I, J, K, K, and L on April 4, 2014, from around 21:00 to around 06:00 on the following day, at the gambling place opened as set forth in paragraph (a) of Article 1, Defendant B, and Defendant A 1 draw up 1,000 each card, with four copies of the card, and divided each card into four; then, Defendant B, and Defendant A draw up the card with one to four parts at will on three occasions, with a maximum of approximately KRW 5,00,000, to a maximum of approximately KRW 50,000. The number is the smaller.
