1. The Defendant’s KRW 465,521,00 for the Plaintiff and 5% per annum from September 13, 2018 to July 9, 2020.
Reasons
1. Basic facts
A. On December 27, 1913, 1913, “B Confucian Schools” was under the circumstances that “Seoul-do, Taenam-do, Seoul-do, and KRW 1,942 (hereinafter “instant land”).”
B. Pursuant to military law No. 194 (No. 194, May 17, 194, 194), the Plaintiff was a Confucian School Foundation established in the jurisdiction of Jeju-do, and was the owner of the land before the instant partition.
C. On August 4, 1957, the land category before the instant partition was changed to forest land. D.
According to the former Farmland Reform Act (repealed by Act No. 4817, Dec. 22, 1994; hereinafter “former Farmland Reform Act”), the Defendant purchased the land before the instant subdivision from the Plaintiff, and completed the registration of ownership preservation in the name of the Defendant on September 22, 1975.
E. On January 20, 1986, the land before the instant partition was divided into D Forest 4,960 square meters (hereinafter “D Forest”), E forest 1,133 square meters, and F forest 327 square meters.
F. On October 23, 1990, the defendant sold D forest land to South Jeju-gun, and completed the registration of ownership transfer based on sale under the name of South Jeju-gun on October 29, 1990.
D Forest was divided into D Forest land 4,55 square meters (the land category was changed from forest land to sports site on November 19, 2007) in Seopo-si, Seopo-si, Jeju Special Self-Governing Province on November 12, 1997 and 405 square meters in G forest.
G. As to the instant land after January 9, 2007, Jeju Special Self-Governing Province completed the registration of ownership transfer based on the succession of rights as of July 1, 2006 by Jeju Special Self-Governing Province, and H (hereinafter “H”) completed the registration of ownership transfer based on the non-sale of the special agreement for repurchase as of November 1, 2006. On August 6, 2012, 199, Co., Ltd. I (hereinafter “I”) completed the registration of ownership transfer based on the merger of companies as of September 30, 208, and the registration of ownership transfer based on the trust as of July 31, 2012 by Jeju Special Self-Governing Province.
