The prosecutor's appeal is dismissed.

The gist of the grounds for appeal by the prosecutor is that the punishment imposed by the court below (three million won of fine) is too uneasy and unreasonable. However, in full view of various circumstances, such as the damage amount of this case (30,000 won) and the victim does not want to be punished by the defendant, the circumstances leading to the defendant's crime, the defendant's age, character and conduct, environment, and circumstances after the crime, etc., the prosecutor's argument above is without merit, since it is deemed that the sentence imposed by the court below is too uneasy and unreasonable.

Accordingly, the prosecutor's appeal is dismissed pursuant to Article 364 (4) of the Criminal Procedure Act.
