Defendant
A shall be punished by imprisonment with prison labor for three years, and imprisonment with prison labor for six months for a crime of Article 2 of the judgment.
Reasons
Punishment of the crime
1. On March 18, 2011, Defendant A was sentenced to one year of imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Embezzlement) in the Daejeon High Court on September 21, 201, and completed the execution of the sentence in the Daejeon Prison on September 21, 2011
around 22:00 on November 9, 201, the Defendant stated to the effect that “The Defendant would purchase a Jnice Tourist Bus in KRW 147,000,000,000” from the H used vehicle trading company located in Daegu Northern-gu G, Daegu-gu, the Defendant would first pay the remainder of KRW 10,000,000 as the down payment and obtain a loan from a bank as collateral or receive a loan from a capital company as collateral for the said bus.”
However, in fact, the Defendant did not own real estate to be offered as security, and does not meet all the requirements for receiving a loan from a capital company as security, and as such, the above sales contract was concluded and the above bus was handed over and then disposed of as a "large-scale car" immediately after delivery of the bus, the Defendant did not have the intent or ability to pay the balance even if it entered into a sales contract as above and received the bus from the victim.
Nevertheless, the Defendant, as above, made a false statement to the victim and obtained the amount equivalent to KRW 147,00,000 of the above bus market price from the victim at the K parking lot located in Daejeon Seo-gu on the 16th of the same month.
