Punishment of the crime
around March 6, 2008, the Defendant: (a) purchased the victim D with a total of KRW 6680,000 square meters of KRW 770,00,000,000,000 from E, Nam-gu, Gyeonggi-gu, Gyeonggi-do; and (b) made a false sale contract concerning the said land with a loan of KRW 350,00,000 to KRW 350,000,000,000 from the above land as security, and paid KRW 200,000,000 to the party as the down payment. An intermediate payment of KRW 35,00,000,000 from the above land as joint collateral and paid KRW 27,00,000 to the Plaintiff by March 7, 2008.
However, even if the defendant extended the above land to the victim as collateral, he did not have the intention or ability to purchase the above land by paying the part payment and the balance of the above land normally to the victim.
Ultimately, on March 6, 2008, the Defendant, by deceiving the victim as above, caused the victim to set up a right to collateral, which is a sum of KRW 525 million, on the said land, and subsequently, took out a loan from H by the bond business operator H to KRW 350 million among those loans, and obtained KRW 150 million from the bond business operator H as sales contract deposit, and obtained the remainder loan worth KRW 200 million and KRW 200 million.
