A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
The Defendant was a person who operated Integrative Business D in Bupyeong-gu, Seoul, the U.S.A., and around 2007, the financial condition of the above company was worse, and thereafter, was bad credit since around 201, and the contract amount was received as a franchise, and there was a situation in which the subcontractor could not pay the construction price to the subcontractor by making a prompt return to another construction site upon receiving the payment of the contract amount. As such, there was no intention or ability to return the completed or received construction price even after receiving the construction price from the victims.
1. From December 9, 2012 to December 19, 2012, the Defendant made a false statement to the effect that “The Defendant would complete construction works for five million won for three days from December 17, 2012 to December 19, 2012, in entering into an internal remodeling contract at G clothing stores operated by the victim E in Ansan-gu, Ansan-si.”
As such, the Defendant, by deceiving the victim as such, acquired 2 million won on the same day from the victim and 1 million won on December 12, 2012 from the victim and acquired 3.5 million won in total under the pretext of down payment and intermediate payment over two occasions.
2. Around January 11, 2013, the Defendant committed the crime against the victim H made a false statement to the effect that “The Defendant would complete the office interior interior interior interior interior construction work at the J company’s office operated by the victim H, which was operated by the victim H, and that “the Defendant will complete the office interior construction work from 10,100 won to 10,010,000 won.”
As such, the Defendant, by deceiving the victim as such, obtained KRW 3 million from the victim, KRW 2 million around January 18, 2013, KRW 2 million around January 20, 2013, KRW 2.6 million around January 23, 2013, KRW 300,000 around February 23, 2013, and KRW 10,10,000 in total as construction cost, around February 7, 2013.
3. On January 15, 2013, the Defendant committed a crime against the Victim K at the victim K’s office located in Seo-gu, Daegu Metropolitan City.
