피고인은 경기 연천군 B에서 ‘C’ 라는 상호로 굼벵이 사육 업을 영위하는 사람이다.

그럼에도 피고인은 2016. 8. 19. 경 위 ‘C’ 사육장에서 굼벵이를 사육하여 굼벵이 분말 제품을 만들기로 마음먹고 인터넷 사이트인 네이버 스토어 (D )에 ‘E, 문헌으로 보는 굼벵이 효능 - 동의 보감 탕액 편 중부에 간에서 비롯되는 질병, 간암, 간 경화, 간염, 유방암, 누적된 피로의 해소 및 옆구리 결린 데, 눈의 군살, 복수가 차서 헛배가 부른 데, 월경 불순, 시력 감퇴, 백내장, 금 창, 산후풍, 악성 종기, 구내염, 파상품, 치질과 치루, 중풍, 당뇨 등의 성인병을 치료하는데 탁월한 효과가 있다’ 라는 내용의 광고를 하여 식품에 관하여 질병의 예방 및 치료에 효능ㆍ효과가 있거나 의약품 또는 건강기능식품으로 오인 ㆍ 혼동할 우려가 있는 내용의 표시ㆍ광고를 하였다.
