A defendant shall be punished by imprisonment for four years.

The defendant shall pay 5,900,000 won to the applicant for compensation by deceit.

Punishment of the crime

On April 13, 2007, the Defendant was sentenced to three years of imprisonment with prison labor for the crime of forging official documents at the Daejeon District Court on June 11, 2009, and the execution of the sentence was terminated in the Sejong District Court on December 18, 2009. On May 6, 2010, the Defendant was sentenced to six months of imprisonment with prison labor for a crime of fraud, etc. at the Daejeon District Court’s official assistance branch on December 18, 2009.

1. Fraud;

A. A. On August 23, 2010, the Defendant made a false statement to the victim that “The Defendant would not have any money to purchase boomed to Dongdong people. If he/she borrowed money, he/she will be repaid to the same incidental personnel.”

However, in fact, the defendant was not a soldier on active duty, and he was approaching the military uniform attached with the master rank of the Pyeongtaek Marine Corps, and was able to do so as if he was a soldier, and was able to believe her status, and he did not have an intention or ability to repay the money even if he borrowed the money from the victim.

As such, the Defendant, by deceiving the victim, received 500,000 won from the victim's position and acquired it by fraud.

(2) On August 24, 2010, the Defendant made a false statement to the victim “H” operated by the victim in Seosan-si G, Seosan-si, stating that “I will have to remove the grix and then deliver it to the victim. If I would have borrowed one million won as I would have borrowed the head of the Tong in the incidental office, because I would have to bring the head of the Tong to the subordinate office.”

However, the defendant did not have any intention or ability to repay the money even if he borrowed the money from the victim as stated in the preceding paragraph.

As such, the Defendant, by deceiving the victim, received one million won from the victim on the same day on the same day.

(3) The Defendant borrowed 50,000 won to the victim at the same place as the day set forth in the preceding paragraph at around 15:28.
