A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On November 2, 2012, around 13:00 on November 2, 2012, the Defendant: (a) intruded with the back windows set forth in 402 of Dadong 402; and (b) stolen Samsung P50 E’s market price at the victim E-owned KRW 50,000.
2. On November 9, 2012, the Defendant: (a) 01:30 on November 9, 2012, the Defendant: (b) intruded the victim’s new card owned C by using a crepan in which windows are opened, and then stolen by holding one copy of the new global gift certificate equivalent to KRW 4,000,100, and KRW 100,000.
3. Fraud or violation of the Specialized Credit Finance Business Act;
A. On November 9, 2012, around 02:24, the Defendant: (a) by deceiving the victim G by acting as if he had no right to use a stolen credit card, as prescribed in paragraph (2); (b) by deceiving the victim G by acting as if he had a legitimate right to use the credit card; (c) obtained a tobacco equivalent to KRW 2,700 of the market price from the victim; and (d) issued the credit card sales slip to the victim and used the stolen credit card.
B. On November 9, 2012, around 02:42, the Defendant, at the office of the H sports marina office in Gyeyang-gu Incheon Gyeyang-gu, by deceiving the victim I in the same way as paragraph (a), obtained the same amount of financial benefits in an amount equivalent to KRW 130,000 at the market price, and used credit cards stolen by issuing signature on the sales slip to the victim.
C. On November 9, 2012, the Defendant, at around 04:20 on November 9, 2012, by deceiving the Victim K by the same method as Paragraph (a), received the same amount of financial benefits from the victim, and acquired the same amount of financial benefits from the victim, and issued a credit card sales slip to the victim, and used the credit card stolen by issuing it to the victim.
4. The Defendant who attempted fraud is the same as the above 3-A in Gyeyang-gu Incheon Lart around November 9, 2012.
