Reasons
1. Facts of recognition;
A. On October 21, 2013, the Plaintiff announced a bid for the lease of a store in the station. The Plaintiff determined the person who presented the highest price above the estimated price among two or more effective bidders as the successful bidder, and became aware that it was dealt with at the time of a single bidding. 2) The Defendant proposed a bid to D who discussed the same business in order to prevent the failure due to a single bid.
D has accepted its proposal.
Based on the open minimum bid price of KRW 214,650,000, the Defendant decided to participate in the tender with KRW 225,382,510 (tender bond of KRW 11,269,200) plus KRW 5%, and KRW 221,098,50 (tender bond of KRW 11,054,475) plus KRW 3%.
3) The Defendant: (a) around 15:20 on October 29, 2013; and (b) around 15:36 on the same day, around 15:36 on the same day, the store No. 151-06 for 1, Jung-gu Seoul, Jung-gu, Seoul (attached Form No. 1, 2, 3, 4, and 1 (hereinafter referred to as the “instant store”).
A) The former tender document on D was submitted as indicated in advance. The Defendant was determined as a successful tenderer. The bid bond paid by D was forwarded to the Defendant immediately before the tender. D collected the bid bond on October 30, 2013 and immediately returned it to the Defendant. The Plaintiff was conducting the bid for the instant store on June and July 2013, but failed to comply with the bid. (b) On November 11, 2013, the Plaintiff, including the lease of the instant store between the Defendant and the Defendant, entered into a lease contract (A 1) with the Defendant and the instant store selected as a successful tenderer in the open competitive bidding on November 11, 2013.
The main contents of the instant case are as follows.
Contract term: Contract price of between November 11, 2013 and December 10, 2016: 225,382,510 won: 112,70,000 monthly rent of KRW 112,70,00: General Conditions of 6,260,600 rental deposit of KRW 10;
B. 10% of the rental deposit after four months from the time of delay or rejection of a tenant’s order.
