A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, with bad credit standing, was unable to obtain a credit card under the name of the Defendant, and was able to use the credit card under the name of the mother B.

1. On April 15, 2012, the Defendant entered the Samsung Card’s name on the Samsung Card’s website without authority for the purpose of interfering with the issuance of the Samsung Card’s card, and entered it into the Samsung Card’s personal information. On the 24th of the same month, the Defendant forged one copy of the Samsung Card’s application form in the name of electronic records, which is electronic records on rights and obligations, by entering B in the personal information of the Samsung Card’s application form on the above website.

2. On April 24, 2012, the Defendant submitted the electronic records on the application form for Samsung Card, which was written as set forth in paragraph (1), to the Internet Samsung Card website without knowledge of the fact.

3. Around April 25, 2012, the Defendant forged a private signature by entering B’s signature in the delivery information column of Samsung Card receipt, while receiving Samsung Card’s application for issuance from Samsung Card Delivery Company E, at the same place as Paragraph (1).

4. The Defendant, at the same time and place as Paragraph 3, submitted to the above E a receipt of Samsung Card containing a forged private signature, and exercised it.

5. The criminal defendant committed the act as if he were B, at the same time, at the same place as in paragraph 3, and acquired one Samsung Card in the name of B from the above E and acquired it by fraud.

6. On March 28, 2014, the Defendant received cash loans of KRW 1.1 million over two occasions by inserting the Samsung Card and inputting the password, at a cash withdrawal point installed at the convenience store next to Busan Shipping Daegu C, Busan, and around March 28, 2014.
