피고인은 2013. 4. 2. 01:50경 서울 강북구 B 소재 C 파출소 앞길에서, 피고인이 직전에 술에 취하여 택시요금을 내지 아니하고 노상에서 횡설수설하여 위 파출소 소속 경사 D가 피고인의 동의하에 피고인을 순찰차에 태워온 후 피고인에게 “비를 맞으니 일단 파출소로 들어가자”고 하자, “너 재수 없는 새끼”라고 욕설을 하며 위 D의 멱살을 손으로 잡아 흔들고 주먹으로 가슴을 2회 쳐, 이에 불상의 경찰관이 피고인을 진정시키기 위하여 종이컵에 물을 담아 건넸으나 이를 뿌리치며 재차 위 D의 멱살을 잡고 ”너 잘 만났다 시발아, 저 개새끼 재수 없어, 너 그 표정이 재수 없다, 카메라로 그 표정 찍어 놓아야겠다, 이 씨발아 나 잡아가 씨발 경찰이면 다야“라고 욕설을 하였다.

In such a way, the Defendant interfered with the legitimate execution of duties of the above D on the prevention and investigation of crimes for about 20 minutes.
